1. Introduction

 

Be Your Realtor (“we”, “us”, “our”) is an AI-powered property selling platform operating in Australia. We provide a marketing and facilitation service that allows sellers to list their property online and be connected with verified buyers and buyers’ agents.

 

We are not a licensed real estate agent and do not provide property, financial, or legal advice. Our role is limited to providing a platform for advertising and marketing. By using our services, you agree to these Terms & Conditions.

 

2. Use of the Platform

 

When creating a listing, you agree that:

• You are the legal owner of the property or have proper authority to sell the property.

• You will not upload false, misleading, fraudulent, or offensive information or material.

• You are solely responsible for the accuracy and completeness of all property details you provide.

• Before disclosing buyer contact details, we may request confirmation of your ownership or selling authority.

• Anyone (owners, representatives, or authorised agents) may create a listing, provided they comply with these Terms.

 

We reserve the right to suspend or remove any listing that breaches these Terms.

3. Fees & Payments

 

• It is free to create and publish a property listing on Be Your Realtor.

• A fixed one-off fee of AUD $1,900 (inc GST) is payable per property once verified buyers or buyers’ agents are found.

• Buyer contact details will only be disclosed once payment of this fee has been received.

• Fees are non-refundable once buyer contact details have been revealed.

• Until that point, no fee is payable. We reserve the right to amend fees at any time, but changes will not apply retrospectively to listings that are already live.

4. Marketing & Data Use

 

You grant us permission to use your property details, features, photos, and descriptions for marketing and promotional purposes, including digital advertising and social media campaigns. We may disclose property information to buyers, buyers’ agents, or third-party service providers engaged in delivering our services. Personal contact details (name, phone, email) will only be disclosed to verified buyers or buyers’ agents once the fixed fee has been paid.

 

5. Limitation of Liability

 

• We make no guarantee that your property will be sold or that you will receive offers. Our role is to provide exposure to potential buyers.

• We are not responsible for the conduct, actions, or representations of buyers, buyers’ agents, or third parties.

• We are not liable for any technical errors, downtime, or service interruptions that may impact your listing.

• To the fullest extent permitted by law, our total liability to you in relation to any claim is limited to the amount you have paid to us (AUD $1,900 per property listing).

 

6. Indemnity

 

You agree to indemnify and hold Be Your Realtor harmless from any claims, losses, damages, liabilities, or expenses (including legal costs) that arise out of:

• Your breach of these Terms,

• False, misleading, or unauthorised property listings, or

• Any unlawful or improper use of the platform.

7. Termination & Suspension

 

We reserve the right to remove any listing or suspend/terminate your access if:

• You breach these Terms,

• We reasonably believe you are acting unlawfully, misleadingly, or fraudulently, or

• Your content is offensive, inappropriate, or harmful to our platform.

 

8. Governing Law

 

These Terms are governed by the laws of Australia. Any disputes will be subject to the jurisdiction of Australian courts and tribunals.

 

9. Changes to Terms

 

We may update these Terms & Conditions at any time. If changes are made, they will be published on our website, and continued use of the platform will constitute acceptance of the revised Terms.
